Terms of Use

1. About these terms. These terms cover two things: the use of this website, and the design work Pixelfield Horizon agrees to do for clients. Sections 2 to 6 apply to everyone who reads the site. Sections 7 to 12 apply once a written quotation has been accepted. If a quotation says something different, the quotation prevails for that project.

2. What the site is.The site is an introduction to the studio. It is not a shop. It shows no prices, has no checkout and makes no offer that you could accept by clicking a button. A project exists only after we have confirmed a written quotation and you have accepted it.

3. The articles. The articles describe general practice in typesetting, printing, packaging and web handoff. They are not legal, tax, trademark or technical advice. Print specifications differ between printers, so check the data guide of your own printer. If you need a trademark or design-registration search, ask a registered patent attorney (benrishi); we do not carry those out.

4. Our material.Unless another source is named, the text and page design belong to Pixelfield Horizon. Photographs on the site are illustrative stock images and may be licensed from third parties; they are not examples of client work.

You may link to any page and quote a short passage with credit. Copying whole pages, or reusing our material in a commercial context, needs our written permission.

5. Using the site properly. Please do not try to disrupt the site, to read it by automated means at a rate that could slow it down, or to collect the email address shown here for unsolicited mailings. If you find a mistake or a broken page, write to us and we will look at it.

6. Links to other sites.Where a page links to another website, that site is not ours and its content is its owner's responsibility. A link is not an endorsement.

7. Quotation and scope. Each project is set out in a written quotation. It states what will be delivered, how many directions and rounds of revision are included, the schedule, the fee, expenses that are charged separately, and what you need to supply. Work outside that scope needs a new or amended quotation. Nothing is invoiced before the quotation is accepted.

8. What the client provides. You provide accurate material and confirm that you may use the texts, images, logos and data you give us. Fonts, stock images and printing are paid for separately unless the quotation says they are included. You remain responsible for approving proofs, including a colour check with the printer before a print run starts.

9. Rights in the finished work.Unless the quotation says otherwise, once the fee has been paid in full you receive the right to use the delivered final files for the purpose agreed in the quotation, and to hand them to your printer, developer or other designers. Concepts and drafts that were not chosen remain with the studio.

Third-party fonts, stock images and software keep their own licences. We show finished work in our own portfolio only with your agreement.

10. What we do not provide. We do not write copy, take photographs, build or host websites, or run the printing, unless the quotation says so. We do not give legal advice. Packaging for food, cosmetics and similar goods carries legally required labelling; the content of that labelling is the client's responsibility and we only lay it out.

11. Cancellation and changes.Either side can end a project. The quotation states how work done up to that point is charged. Rights that the law gives to consumers are not affected by these terms.

12. Liability. To the extent the law allows, Pixelfield Horizon is not liable for indirect or consequential loss arising from the use of this site or of the articles. This does not limit liability for intent or gross negligence, or any liability that cannot be excluded under Japanese law, including the Consumer Contract Act.

13. Changes to these terms. We may revise these terms as the business changes. The version published here is the one in force, and material changes appear on this page with a new date.

14. Governing law. These terms are governed by Japanese law. We would always rather settle a problem by talking first. If a dispute cannot be settled that way, the court with jurisdiction under the Code of Civil Procedure decides it.
